DEADLINE TO REGISTER WITH CHINA TO PROTECT EXPORTS DISTILLERS GRAINS

U.S. companies that produced and/or shipped distiller’s dried grains (DDGs) to the People’s Republic of China confront an expedited deadline for considering and determining whether to register to protect their interests in response to that country’s launch of an anti-dumping investigation.  In a notice issued Dec. 28 (Notice 99), the Chinese Ministry of Commerce announced that it plans to Investigate the alleged dumping of DDGs, with and without solubles, produced and/or shipped from U.S. suppliers during the period of July 2009 through June 2010.  China has indicated it ultimately may expand its antidumping investigation against American DDGs dating to 2007. 

U.S. companies involved in the production of ethanol and DDGs (with and without solubles), including shippers, to China may find it in their best interest to register with the Chinese government to participate in the anti-dumping proceeding.  If the Chinese government’s investigation results in a finding that the dumping of U.S. DDGS did occur during the timeframe specified in the investigation, it could impose punitive tariffs on U.S. exports of those products.  Under World Trade Organization rules, those punitive tariffs, if applied, could be as much as 50 percent higher for non-registered parties compared to those that register with China.
