OSHA CONSIDERING CRIMINAL CHARGES IN FUTURE FATALITIES

 

Below in PDF is a press release that OSHA issued this week regarding $721,000 in proposed fines against Cooperative Plus, a firm headquartered in Burlington, WI.  The proposed fines are in response to a non-fatal engulfment incident that occurred in February.

Based on the Cooperative Plus issue and some other recent engulfment incidents involving fatalities, the Agency will be sending the attached letter to all grain handling facilities within the next few weeks.  In the letter, OSHA states they will consider referring all future cases that involve fatalities to the Department of Justice for criminal prosecution.

The National Grain and Feed Association (NGFA) is in the process of scheduling a meeting with senior OSHA staff to further discuss the issue of grain bin safety. I will follow-up with any additional information that we obtain based on our interactions with OSHA.

Please pay particular attention to the letter from the Assistant Secretary of OSHA regarding the recent incidents of engulfment fatalities and the proposed action the agency may consider with future violations which can be downloaded here.  We suggest you print a copy of this letter and post it prominently at your facilities.  We have also attached a press release regarding the Wisconsin elevators violation and proposed fine.
